These terms and conditions (“Terms”) apply to the entire contents of this website under the domain name vapebuy.co.uk (“Website”) and to any correspondence by email between us and you. Please read these terms carefully before using this Website. Using this Website indicates that you accept these terms regardless of whether or not you choose to purchase from us.

2. Age Restrictions (18+ Only)

2.1. By law, we cannot sell electronic cigarettes, e-liquids, or related vaping products to anyone under the age of 18.
2.2. By placing an order on this Website, you confirm that you are at least 18 years old.
2.3. We reserve the right to verify your age using third-party age verification services. These checks are performed in the background using the details you provide at checkout (Name, Address, Date of Birth). This is an identity check, not a credit check, and will not affect your credit score.
2.4. If we are unable to verify your age automatically, we will ask you to provide valid proof of age (such as a driving licence or passport) before your order is dispatched.
2.5. We reserve the right to cancel any order if we cannot verify that you are over 18.

3. Products, Safety & Medical Disclaimer

3.3. Battery Safety: Lithium-ion batteries (used in many vape devices) carry inherent risks if handled improperly. By purchasing these items, you acknowledge that you understand how to handle them safely.

Always charge batteries on a fire-proof surface and never leave charging batteries unattended.
Do not use batteries if the outer wrap is torn or damaged.
Do not carry loose batteries in pockets or bags where they may come into contact with metal objects (keys, coins), as this can cause a short circuit or explosion.
Vape Buy accepts no responsibility for damage or injury caused by the misuse, mishandling, or modification of batteries or devices.

4. Contract Formation & Order Acceptance

4.1. All orders are subject to acceptance and availability.
4.2. After placing an order, you will receive an acknowledgement email. This does not mean your order has been accepted.
4.3. The contract between us is only formed when we send you a Dispatch Confirmation email.
4.4. We reserve the right to cancel an order prior to dispatch for any reason, including but not limited to:

Inability to verify age.
Product pricing errors or description errors.
Items being out of stock.
Suspicion of fraud.
The delivery address is in a country we do not ship to.

5. Pricing & Payment

5.1. All prices are shown in GBP (£) and include VAT where applicable.
5.2. We make every effort to ensure pricing is correct. However, if we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it.
5.3. Payment must be made in full before goods are dispatched.

6. Delivery

6.1. Delivery timescales are estimates only. While we aim to dispatch all orders promptly, we cannot be held responsible for delays caused by third-party couriers (e.g., Royal Mail), strikes, or adverse weather conditions.
6.2. Risk of loss and damage of products passes to you on the date when the products are delivered.
6.3. Missing Items: If your package arrives missing items or is deemed lost in transit, you must notify us within 48 hours of the expected delivery date via support@vapebuy.co.uk

7. Returns & Refunds

Our returns policy complies with the UK Consumer Rights Act 2015, with specific exceptions for hygiene-sensitive products standard in the vaping industry.

7.1. Hygiene Exclusion (Important): For health and hygiene reasons, we cannot accept returns of e-liquids, disposable vapes, clearomizers, tanks, pods, or coils that have been opened, unsealed, or used, unless they are faulty. Once the seal is broken on these items, they are strictly non-returnable.

7.2. Hardware & Unwanted Items (Right to Cancel):

You have the right to cancel your order for unwanted hardware (mods, kits, batteries) within 14 days of receiving goods, provided they are unopened, unused, and in their original sealed packaging.
You must notify us via email before returning any items.
The customer is responsible for the cost of returning unwanted items.

7.3. Faulty Items & Warranty:

Dead on Arrival (DOA): If an item is faulty on arrival, please contact us within 48 hours. This is especially important for disposable items (coils, pods, disposables) which are not covered under long-term warranty due to their consumable nature.
Hardware Warranty: Vape mods and kits generally come with a manufacturer warranty (typically 3-6 months) covering manufacturing defects (e.g., chip failure). This does not cover wear and tear, accidental damage, USB ports damaged by improper charging, or damage caused by dropping the device.

8. Limitation of Liability

8.1. Nothing in these Terms limits our liability for death or personal injury caused by our negligence.
8.2. Subject to clause 8.1, Vape Buy shall not be liable for any indirect or consequential loss, loss of profit, loss of business, or depletion of goodwill arising out of or in connection with the use of our products.
8.3. Our total liability to you for all other losses arising under or in connection with the Contract shall not exceed the purchase price of the products you purchased.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
